Read SARASOTA FLORIDA DUI ATTORNEY Finebloom & Haenel's Answers About Florida DUI Laws

  • Can I fight my Florida DUI?

Simply speaking, yes. We can review every aspect of the case, from the reason that you were stopped, to the validity of the field sobriety tests, to the maintenance of the breathalyzer machine, to the validity of the results. We will conduct a thorough review of all the facts and laws regarding your Florida DUI case.

Also, We will discuss the case with the prosecutor and judge, pointing out your background, your job, and the need for you to keep your license.

  • What is illegal under  Florida DUI laws  ?

In Florida, the charge of Driving Under the Influence of Alcohol or Drugs (DUI) alleges that your Blood Alcohol Concentration (BAC) was .08% or greater when operating or attempting to operate a vehicle or that you operated or attempted to operate a vehicle while under the influence of alcohol, drugs or any combination of alcohol and drugs to a degree that rendered you incapable of safely doing so.   Because  Florida DUI law  provides for conviction under either leg of this split standard, thorough and aggressive defense of a DUI charge requires the skills of a qualified Florida DUI defense lawyer. Florida DUI cases are procedurally consistent with any other criminal charge in that the prosecution bears the burden of proving the charge beyond a reasonable doubt.   However, because of an increased public intolerance of drinking and driving, defending against a Florida DUI charge has become increasingly more complicated, and the penalties for conviction have become much more serious. In order to defend against a Florida DUI case, your attorney must be ready and able to attack the Government's evidence of intoxication. There are a number of avenues that an experienced, thorough Florida DUI defense attorney can pursue in order to defend the client.   Countless DUI cases have been won by contesting the constitutionality of any stops, searches and seizures; challenging the precision and proficiency with which the arresting officer conducted the field sobriety tests; challenging the training and experience of the individuals who conducted any chemical tests as well as the test results themselves; and by testing the credibility and reliability of the statements of any witnesses.
  • Since the test result indicates my BAC was .08 or more, am I going to be found guilty?

Not necessarily. There are many tactics and strategies to use when defending Florida DUI cases. In certain circumstances we can successfully challenge the procedures used when administering the test and the accuracy of the test result.
  • What should I look for when hiring a Florida DUI Attorney or Lawyer?

The Law Firm of Finebloom and Haenel is committed to providing you the best legal representation possible. Our attorneys, one of whom is the former State of Florida DUI prosecutor of the Year, have represented clients charged with everything from a traffic ticket to a felony. Our firm is experienced and aggressive and will work tirelessly to get you the best result in your case.
  • After hiring our experienced team of professional attorneys, you can trust that our firm will work collectively to zealously represent you from the very beginning of your case until its resolution in the legal system. Unlike many law firms, the Law Firm of Finebloom and Haenel is open 7 days a week to help you with your legal needs. Our two law offices, in Sarasota and Brandon/Tampa, are positioned in close proximity to the clerk and the surrounding communities to better serve you. Whether you were referred by a former client, another attorney, or as a result of an internet search, you can be sure that you have found the right team of lawyers to represent you.
  • The firm is diverse in nature and includes four attorneys whose backgrounds bring a thorough understanding of the law and client interaction. With over 20 years of combined experience, Finebloom and Haenel is the legal team you should want on your side in the toughest of times.
  • Our team of lawyers, whose experience includes both the State Attorneys office as well as the public defenders office, is geared to providing critical advice to our clients from both sides of a case; advice which provides our clients unparalleled insight into their individual case. For example, on many occasions, clients will ask us how and what we know about their particular issue - we know radar and laser cases because we own these speeding devices and have participated in the same training as the police; we know how to challenge your case, whether it be DUI, battery or drugs, because we used to prosecute them. We know we can't dismiss or reduce every case, but we work extremely hard to do that for each client.
  • In addition, several of our employees speak Spanish and a majority of the lawyers have advanced degrees other than their law degree. Call our Tampa office at 813-649-8690 or the Sarasota office at 941-953-2622 to schedule your appointment today. In many instances we can give you a FREE CONSULTATION over the phone and we accept all types of major credit cards.
  • We are dedicated to defending you in the roughest of times.
  • We cover the following counties and cities:
  • Sarasota County, Florida: Sarasota, Venice, Longboat Key, North Port, Osprey, Nokomis, Casey Key, Englewood
Manatee County, Florida: Bradenton, Lakewood Ranch, Holmes Beach, Bradenton Beach, Palmetto, Anna Maria, Ellenton, Parrish
Pinellas County Florida: Oldsmar, Clearwater, Bellair, Dunedin, Gulfport, Indian Rocks Beach, Kenneth City, Largo, Madeira Beach, Pinellas Park, St. Pete Beach, St. Petersburg, Seminole, Tarpon Springs, Treasure Island
Hillsborough County, Florida: Tampa, Brandon, Temple Terrace, Sun City, Plant City, East Tampa, Lithia, Lutz, Macdill, Wimauma, Valrico
Charlotte County: Punta Gorda, Englewood, Port Charlotte, Rotonda
Pasco County: Bayonet Point, Beacon Point, Dade City, Elfers, Gulf Harbors, Holiday, Hudson, Lacoochee, Land O' Lakes, New Port Richey, Odessa, Port Richey, San Antonio, Shady Hills, St. Leo, Trinity, Wesley Chapel, Zephyrhills

Our experience has taught us to consider the following:

  1. The initial traffic stop Did the officer have a valid reason to stop the suspect?
  2. The DUI investigation Did the officer have valid suspicion of elevated blood alcohol content?
  3. The field sobriety tests - Did the officer administer the field sobriety tests correctly?
  4. The chemical test at the station Did the officer follow required protocol for administration of the Intoxilyzer?

If the answer to any one of these questions is "no" there may be a strong basis to file a motion to suppress the evidence in your case or to successfully challenge the sufficiency of the evidence at trial.  We look at everything in order to obtain the best possible outcome for our clients. Not every driver arrested for Florida DUI is guilty of the offense.

  • Experience Makes the Difference

In defending against DUI charges, experience counts.  We prepare every case We handle as though it were going to trial.  We believe that is the only way to truly know the detailed facts of each case.  If a better outcome is available by means of plea negotiations, we have always believed that the prosecutor is much more likely to make a favorable offer in a case that he or she knows the Defense is prepared to try if necessary.

If you have been charged with an alcohol related driving offense, you need our skilled legal representation immediately to protect your future.  We urge you to contact our Sarasota Florida DUI defense lawyer today.
